User Agreement:

Hemswell Antique Centres and its related sites, services, applications, and tools (each and collectively, the “Site”) are owned and operated by Hemswell Antique Centres  (“Hemswell Antique Centres,” “Us” or “We”). These terms and conditions (“Terms”) govern your use of the Site and your conduct on the Site.

Acceptance of Terms and Privacy Policy; Modification

Hemswell Antique Centres provides you with access to and use of the Site subject to your compliance with these Terms and the Site’s Privacy Policy. Your use of the Site constitutes your express agreement to these Terms and our privacy policy. If you do not agree to these Terms or our privacy policy, you may not access or use the Site.

Making a Purchase: 

HAC sells on behalf of dealers trading from its premises (“Dealers”) and operates at all times as agent for those Dealers when offering goods for sale accepting orders and arranging delivery on their behalf. 

We check stock availability and contact you by phone or e-mail regarding payment, postage and delivery options. We can take payment from your debit card (or credit card +1.5%). Once this has been done we will confirm, by e-mail, that your order has been received and accepted. 
Subject to further validation checks that we may choose to make, our acceptance of your order brings into existence a legally binding contract between us.

We accept all orders subject to availability. If your order cannot be fulfilled we will contact you regarding this, and maybe even provide details of an alternative and similar item. 

We accept payment by most major debit and credit cards (credit cards only are subject to a 1.5% surcharge). The card must be registered to the delivery address. 

Payment can be made over the phone by debit or credit card, or alternatively a cheque can be sent to us, although at least 2 weeks clearance is needed before items can be released from the Centres. 

Shipping and Handling: 

Packing charges are included in the price quoted for postage. If van delivery is chosen, packing materials are used in the vehicle. 

Delivery Schedule :
On receipt of your order we will e-mail back confirmation of your order. An invoice & receipt will be posted to you. 

We aim to despatch all: 

Postal Items: Within 7 Days. 

Van Delivery Items: Within 2 Weeks, although this cannot be guaranteed, as it depends mainly on the whereabouts of your location. It might not be possible to deliver to some locations and in relation to export from the United Kingdom a specific arrangement must be made. 

Delivery of goods to you: 

Where agreed we will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. Delivery will be made as soon as possible after your order is accepted and in any event within 30 days of your order. You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.  If you collect the goods or arrange for their collection by a third party then you will become the owner of the goods when so collected whereupon we will not be liable for their loss or destruction. 

It assists us in providing the best possible service to you for our respective commitments and responsibilities to one another to be clearly defined at the point of sale. These commitments are set out below and we request that you read them. 

Before Delivery:

It is your responsibility to advise us at the time of purchasing your furniture of difficulties that may be encountered when delivering to your property ensuring this information is documented on the sales receipt. Any costs incurred affecting delivery will not be the responsibility of Hemswell Antique Centres Ltd i.e. door or window removal etc. 

Hemswell Antique Centres Ltd are only responsible for delivery to your front door. 

It will be at the discretion of the delivery manager for giving assistance within your property but Hemswell Antique Centres Ltd will not be responsible for any damage incurred whilst doing so.

All delivery times given by us are approximate. We always give delivery times in good faith but cannot be held responsible for any direct or indirect loss due to any reasonable delay or delays due to unforeseen circumstances outside of our reasonable control. 

If for any reason a piece of furniture cannot be delivered due to access problems it will remain the property of the customer, any further attempts to deliver by Hemswell Antique Centres Ltd may incur a delivery charge. 

Right for you to cancel your contract: 

You may cancel your contract with us for the goods you order at any time up to the end of the fourteenth working day from the date you receive the ordered goods. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty. 

To cancel your contract you must notify us in writing. 

If you have received the goods before you cancel your contract then you must send the goods back to our contact address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible. 

Once you have notified us that you are cancelling your contract, any sum debited to us from your debit or credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you. 

Cancellation by us: 

We reserve the right to cancel the contract between us if: 

  • we have insufficient stock to deliver the goods you have ordered;
  • we do not deliver to your area; or
  • one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us.

If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered. 

Accuracy of Website: 

We have taken every care in preparing the content of this website, however we cannot guarantee that the information will always be completely up to date and free from mistakes. To the extent permitted by law Hemswell Antique Centres disclaim all warranties express or implied, as to the accuracy of the information contained on this website. 

Descriptions of goods are given in good faith however any such description is given in good faith either by HAC or the Dealer and you should satisfy yourselves on any particular issue of provenance or quality. 

Liability: 

If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 5 working days of the delivery of the goods in question. 

If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the goods. 

If you notify a problem to us under this condition, our only obligation will be, at your option: 

  • to make good any shortage or non-delivery;
  • to replace or repair any goods that are damaged or defective(if available); or
  • to refund to you the amount paid by you for the goods in question in whatever way we choose.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition, and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question as above. 

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase. 

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence. 

Colour Reproduction: 

Hemswell Antique Centres have made every effort to reproduce colours on the site as accurately as possible. However, different computers reproduce colours in slightly different ways. Therefore, the product may vary in colour slightly to that shown on your screen. 

Returns Policy: 

Hemswell Antique Centres sell on behalf of individual dealers, who must be consulted by us with regards to any returns that wish to be made. 

Without prejudice to your right of cancellation set out above and other statutory rights you may have if a return is agreed upon, any delivery or postage costs will not be refunded, and re-collection fees may apply. Also, if any damage occurs during postage, a claim will be made to the couriers, who will again, possibly not return any postage costs. Hemswell Antique Centres accept no responsibility for lost or damaged items. 

Events beyond our control: 

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident. 

Invalidity: 

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected. 

Privacy: 

You acknowledge and agree to be bound by the terms of our Privacy Policy

Governing Law: 

The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us. 

Proprietary Rights:

As between you and Hemswell Antique Centres, (or other company whose marks appear on the Site), Hemswell Antique Centres (or the respective company) is the owner and/or authorised user of any trademark, registered trademark and/or service mark appearing on the Site, and is the copyright owner or licensee of the Content and/or information on the Site, unless otherwise indicated.

Except as otherwise provided herein, use of the Site does not grant you a license to any content, features or materials you may access on the Site and you may not modify, rent, lease, loan, sell, distribute, scrape, duplicate or create derivative works of such content, features or materials, in whole or in part. Any commercial use of the Site or site content is strictly prohibited, except as allowed herein or otherwise approved by us. You may not download or save a copy of any of the content or screens for any purpose except as otherwise provided by Hemswell Antique Centres. If you make use of the Site, other that as provided herein, in doing so you may violate copyright and other laws of the United Kingdom, other countries and may be subject to liability for such unauthorised use. 

We do not grant any license or other authorisation to any user of our trademarks, registered trademarks, service marks, other copyrightable material or any other intellectual property by including them on the Site.

The information on the Site including, without limitation, all site design, text, graphics, interfaces, and the selection and arrangements is protected by law including copyright law.
Product names, logos, designs, titles, graphics, words or phrases may be protected under law as the trademarks, service marks or trade names of Hemswell Antique Centres or other entities. Such trademarks, service marks and trade names may be registered in the United Kingdom and internationally.

Without our prior written permission, you agree not to display or use our trademarks, service marks, trade names, other copyrightable material or any other intellectual property in any manner.

Images created or produced or modified by Hemswell Antique Centres. All images created or produced or modified by Hemswell Antique Centres are the sole property of Hemswell Antique Centres. Hemswell Antique Centres may use any such image to promote the Site or for any other purpose at any time without restriction.

Entire Agreement: 

These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

Competition Terms and Conditions​:

  1. Our competitions are not in any way endorsed, administrated, sponsored by or associated with Facebook
  2. Participants must be aged 18 and over to enter the competitions
  3. Competitions not open to staff, dealers and immediate family of such, at Hemswell Antique Centres
  4. If more than one correct answer is given the winner will be chosen at random
  5. Participants must have a valid UK address to enter
  6. Only one entry per person, multiple entries will be disqualified
  7. The winning prize is neither transferable nor eligible to be exchanged for cash
  8. Winners will have to provide their own transport for competitions where necessary
  9. Hemswell Antiques Centres does not accept liability for any incidences/damage to personal property/personal accidents that may be incurred during participation of the competition prizes
  10. Winner must claim their prize within 7 days
  11. The deadline to use the prize is dependent on the prize won
  12. We will announce the winner in the introduction of the following months theme
  13. We reserve the right to share details of each winner on our Facebook page to demonstrate all competitions are genuine
